4. - What should I do if I want to sell a property through the Sistema Torrent?
The steps to follow in order to sell a property using the Sistema Torrent are as follows:
a) Contact Torrent de Juià S.L. by phone or at the email address that appears on this website.
b) Visit the property with us.
c) Deliver to Torrent de Juià S.L. a copy of all land registration information of the property in order to check it.
d) Deliver to Torrent de Juià S.L. an updated official valuation of the property, made by an independent entity, with a minimum validity period of 3 months. This valuation should be made by a properly accredited entity that is recognized by the majority of the banks in the country. Torrent de Juià S.L. can give advice in this area.
The cost of this valuation is initially supported by the potential seller. If agreement is reached on the opening bid, the auction then takes place and the property is sold; that cost, after liquidating the remaining fee immediately after signing the Public Registration of Sale before a Notary, is then returned to the seller by Torrent de Juià S.L.
e) Based on the valuation outlined in the previous point, reaching a joint agreement on the opening bid of the auction.
f) Sign an Auction Organization Commissioning Contract.
Once this contract is signed, the valuation is used as a basis for making funding studies for potential buyers if necessary.
g) Sign a Staying Authorization Contract.
In this contract the seller allows Torrent de Juià SL. to coordinate stays for potential buyers of the property. It is important to point out that in order to make these stays as satisfactory as possible for the buyer, it is necessary to prepare the property beforehand following certain guidelines established by Torrent de Juià SL. related to cleanliness, hygiene, order and comfort.
The cost of these preparations is initially supported by the potential seller. If the auction takes place and the property is sold, this cost, after paying the remaining fee immediately after signing the Public Registration of Sale, is then returned to the seller by Torrent de Juià SL.
h) Attend one of the Explanatory Presentations held before the auction, which are organized by the Sistema Torrent in the same property which is going to be auctioned (whenever possible). Assistance is optional, since it is recommended but not compulsory.
i) Attend the auction.
The point made in the previous paragraph applies: it is recommended but not compulsory.
In order to attend an auction by the Sistema Torrent as an individual and as a seller, you must be the owner of the property and be aged 18 or over.
If the seller is a legal entity it must also prove the ownership of the property and that there are no restrictions on it participating in an act of this nature. Although in the General Conditions of the Basis of the Auction it states that assistance at an auction is allowed whether as an individual or as a legal entity, you must also consult the Special Conditions of the Basis of each specific auction to assure that there are no restrictions regarding this point.
By definition and for the effectiveness of the System, we try to hold all auctions at the same auctioned property, regardless of the type of property (house, parking space, shop, etc.).
j) Sign the Public Registration of Sale before a Notary.
To explain the Sistema Torrent, Explanatory Presentations are held periodically and before the auction in the property to be auctioned, which presents an opportunity to visit it. Dates and timetable can be consulted in "Explanatory Presentations".
